2. Account Creation, Maintenance, Modification and Cancellation

2.2 Accurate Information
You agree to maintain accurate information within your Client Portal account, including: Full legal name Billing address Telephone number Email address You must update your information within ten (10) days of any change. OMEE Digital Kenya Limited may suspend or terminate services if account information is inaccurate, misleading, incomplete, or fraudulent.

2.3 Account Maintenance and Security
You are fully responsible for: Account credentials Password security Payment method information Activities performed under your account You must promptly notify OMEE Digital Kenya Limited of any unauthorized access or suspected security issue. OMEE Digital Kenya Limited shall not be liable for losses resulting from unauthorized use of customer credentials.

2.4 Responsibility for Content
Customers are solely responsible for: Content hosted on their accounts Applications installed Data stored Activities occurring through their services OMEE Digital Kenya disclaims liability for customer-generated content.

2.5 Account Suspension and Cancellation
OMEE Digital Kenya Limited may suspend or terminate accounts violating these Terms. Customers wishing to cancel services must submit cancellation requests through the Client Portal at least ten (10) days before renewal or expiration.

2.6 Backups
Backups may be provided as a courtesy service. Backup availability cannot be guaranteed. Customers are solely responsible for maintaining independent backups of all critical data. OMEE Digital Kenya Limited is not liable for: Data loss Corrupted backups Failed backup processes Restoration failures

3. Privacy Policy
OMEE Digital Kenya Limited is committed to protecting customer privacy. Our Privacy Policy is available at: https://www.omeedigital.com/privacy-policy OMEE Digital Kenya Limited does not sell customer information except where required by law or necessary to provide contracted services.

4. Related Policies
4.1 Acceptable Use Policy
All customers must comply with our Acceptable Use Policy. Acceptable Use Policy Activities including spam, malware, phishing, unauthorized system access, and illegal content are strictly prohibited.

4.2 Artificial Intelligence Policy

5. Domain Names
Domain registrations, transfers, and renewals are governed by: Domain Name Policy available at: https://www.omeedigital.com//legal/domains Customers must comply with ICANN and applicable registry regulations.

6. Domain Privacy Protection
Privacy Protection services may be available for eligible domain extensions. The service: Protects WHOIS information where supported Does not guarantee removal from historic WHOIS databases Is non-refundable Customers must maintain accurate contact information in their OMEE Digital Kenya Limited account.

7. SSL Certificates
SSL Certificates purchased through OMEE Digital Kenya Limited are subject to the issuing Certificate Authority’s terms and policies. SSL certificates: May require DNS propagation Are non-transferable Are non-refundable after issuance Customers may be required to configure website software to fully enable secure HTTPS functionality.

8. Webmaster & Technical Assistance
Services OMEE Digital Kenya Limited may offer paid technical assistance services beyond standard support. These services may include: Website troubleshooting CMS updates Website migration assistance DNS configuration Security reviews Fees are billed at OMEE Digital Kenya’s current professional service rates. Completed services are non-refundable.

 9. Dedicated IP Addresses
Dedicated IP addresses remain the property of OMEE Digital Kenya Limited. Customers must comply with ARIN policies and applicable regulations. OMEE Digital Kenya Limited reserves the right to: Reassign IP addresses Modify allocations Reclaim unused IP resources Dedicated IP changes may result in temporary website availability issues due to DNS propagation. 

10. Website Transfers
Website migration assistance may be offered as a courtesy service. OMEE Digital Kenya Limited does not guarantee: Successful migrations Complete migrations Compatibility with third-party platforms Specific completion timelines Migration services beyond standard allowances may incur additional fees. 

11. Affiliate Program
Affiliate participation is governed by the: Affiliate Program Terms OMEE Digital Kenya Limited reserves the right to modify affiliate commissions and eligibility requirements. 

12. Reseller Services
Reseller customers are responsible for ensuring their downstream customers comply with these Terms and Conditions. OMEE Digital Kenya Limited may suspend reseller accounts for customer violations. Resellers are responsible for providing first-level support to their own customers.

OMEE Digital Kenya Limited may offer: SEO Services Local SEO PPC Management Content Marketing Digital Advertising OMEE Digital Kenya Limited does not guarantee: Search rankings Traffic levels Sales increases Lead generation results

 14. Service Guarantees
14.1 Money Back Guarantee
Eligible hosting services may be covered by a thirty (30) day money-back guarantee. Non-refundable products include: Domain registrations Domain renewals Domain privacy services SSL certificates Dedicated servers Professional services Setup fees

 14.2 Support Response Commitment
OMEE Digital Kenya Limited strives to respond to support requests within twenty-four (24) hours. This commitment excludes: Incomplete requests Third-party issues Situations outside OMEE Digital Kenya’s control 

14.3 Uptime Objective
OMEE Digital Kenya targets 99.9% service uptime. Uptime calculations exclude: Scheduled maintenance Internet routing issues Customer-generated outages Force majeure events 

15. Renewals
 Services renew automatically unless canceled before renewal dates. Renewal notices may be sent via email and made available within the Client Portal. Customers authorize OMEE Digital Kenya Limited to charge payment methods on file for recurring services unless automatic renewals are disabled. Renewal payments are generally non-refundable once processed. 

16. Payments
 Accepted payment methods may include: Mpesa Visa Mastercard American Express PayPal Electronic Funds Transfer Late payments may incur interest at the maximum rate permitted by applicable law. Returned payments, chargebacks, or payment reversals may result in administrative fees and service suspension. 

17. Refund Policy
Refund requests must be submitted through the Client Portal. Refund eligibility is limited to qualifying services within the applicable guarantee period. Refunds are generally unavailable for: Domain registrations Domain renewals SSL certificates Dedicated servers Professional services Marketing services Consulting services Completed development projects OMEE Digital Kenya reserves the right to deny repeat refund requests from the same customer.

18. Chargebacks and Payment Reversals
 Chargebacks and payment reversals may result in: Administrative fees Service suspension Domain lock or restriction Collection actions Customers remain liable for all outstanding balances. 

19. Disclaimer and Limitation of Liability
 All services are provided on an “AS IS” and “AS AVAILABLE” basis. OMEE Digital Kenya Limited disclaims all warranties, including implied warranties of: Merchantability Fitness for a particular purpose Non-infringement OMEE Digital Kenya Limited shall not be liable for: Lost profits Data loss Business interruption Indirect damages Consequential damages Special damages Maximum liability shall not exceed the total amount paid by the customer during the twelve (12) months preceding the claim.

 20. Entire Agreement
These Terms and Conditions, together with: Service Agreements Privacy Policies Acceptable Use Policies Statements of Work Purchase Orders constitute the entire agreement between OMEE Digital Kenya Limited and the customer. 

21. Force Majeure
 OMEE Digital Kenya shall not be liable for delays or failures resulting from: Natural disasters Internet outages Cyberattacks Government actions Labor disruptions Power failures Other events beyond reasonable control

 22. Trademarks and Copyright
The names: OMEE Digital Kenya Limited OMEE omeedigital.com and associated logos, trademarks, designs, software, and content are property of OMEE Digital Kenya Inc. Unauthorized use is prohibited without written consent.

26. Severability and Survival
If any provision of these Terms is held invalid or unenforceable, all remaining provisions shall remain in full force and effect. 

27. Governing Law and Jurisdiction
These Terms shall be governed by and interpreted according to the laws of Kenya and the Province in which OMEE Digital Kenya Limited is incorporated. All disputes shall be subject to the exclusive jurisdiction of the courts of that Province. 

28. Non-Solicitation of Employees
During your relationship with OMEE Digital Kenya Limited and for twelve (12) months thereafter, you may not: Recruit OMEE employees; Solicit OMEE employees for outside work; Employ current OMEE employees; Hire former OMEE employees within one year of their departure from OMEE Digital Kenya. 

29. Respectful Communications
OMEE Digital Kenya Limited maintains a zero-tolerance policy regarding: Harassment Discrimination Threats Profanity Abusive communication Violations may result in service suspension or termination.

 30. Refer-a-Friend Program
Customers with active hosting accounts may participate in the OMEE Digital Kenya Limited Refer-a-Friend Program. Program details, qualifications, rewards, and restrictions may be updated at any time at OMEE Digital Kenya’s discretion.
